Askable AI Acceptable Use

These terms do not apply to you if you do not subscribe to Industry Streams or the AI Add-on as described in the Askable Product Description (collectively the “Covered AI Products”). Capitalized terms not defined in these Terms are defined in the Askable Software Services Agreement and the Askable Data Processing Agreement. These terms are in addition to your obligations under theAskable Software Services Agreement. 

1.1 Use Notice and Disclaimers

1. Covered AI Products may be used in new and innovative ways. Customer is responsible for determining if its use of these technologies is safe. 
2. Covered AI Products is offered on an ‘as is’ basis (subject to any rights you may have under applicable laws and).
3. By agreeing to use or otherwise accessing the Industry Streams, you acknowledge and agree that:
   
   1. the Covered AI Products must be used for internal business purposes only, except for External Use of Permitted Insights in accordance with clause 1.1;
   2. you remain responsible for all activities that occur under your usernames and accounts, including where additional fees are incurred with third party providers;
   3. Askable does not warrant or represent that Covered AI Products are error free, or that it will be uninterrupted and available at all times;
   4. Askable makes no warranties or representations that use of Covered AI Products will achieve any particular results;
   5. Askable does not provide any warranties that the Covered AI Products (or any use of the Covered AI Products ) will be accurate, error-free, reliable or suitable for any purpose; and
   6. Except where the Covered AI Product is replicating the Customer’s data, the Data  provided in Covered AI Products (or any use of the data in relation to the Covered AI Products):
      
      1. may contain errors, omissions, unexpected behaviour or opinions that are not intended to be relied on without appropriate human review and validation;
      2. does not reflect any views, beliefs or opinions of Askable; and
   7. Covered AI Products and Outputs in their raw or identifiable form must not be published, distributed, broadcast, screened, or otherwise communicated publicly. They may be used internally within your organisation solely for analysis and decision-making purposes, and must not be included in any report, presentation, or communication (internal or external) that will be circulated outside the team directly involved in the project. Under no circumstances may any materials containing video, audio, or other identifiable information about a participant or researcher be shared publicly or in any way that could reveal their identity. For clarity, this restriction does not apply to Permitted Insights shared in accordance with the Data Use and Sharing section.
4. You must not, and must ensure Authorized Users do not, download, copy, export, capture, screenshot, screen-record, scrape, extract, or otherwise reproduce any Identifiable Covered AI Product Data. You must not attempt to bypass or circumvent any technical controls that prevent downloading or exporting such data.

1.2 Data Use and Sharing

1. Sharing of Insights
   
   1. You may create and share aggregated insights, observations, trends, or high-level learnings generated through your use of the Covered AI Products (Permitted Insights), provided that such information is fully anonymised and cannot reasonably be used, alone or in combination with other information, to identify any individual, participant, organisation, project, or customer.
   2. Permitted Insights may include: 
      
      1. summarised or aggregated trends; 
      2. market observations; 
      3. statistical or thematic analysis; and 
      4. general industry learnings derived from the Covered AI Product Data or Outputs, provided that none of the above contain any Personal Data or Restricted Information
   3. You acknowledge that any Permitted Insights shared externally are your sole responsibility, must not be represented as endorsed by Askable, and must comply with all applicable laws.
2. Restricted Information
   
   1. You must not publish, disclose, distribute, commercialise, or make available any Restricted Information. Restricted Information includes, without limitation:
      
      1. any video, audio, transcripts, verbatim quotes, or other Identifiable Covered AI Product Data;
      2. unaggregated or session-level data;
      3. any Output that contains Personal Data or resembles identifiable participant content;
      4. any information derived from a small or unique subset of Covered AI Product Data that could reasonably permit re-identification; and
      5. any raw data, footage, or materials sourced directly from Askable or its participants
   2. Restricted Information must not be used in any external reports, presentations, marketing, client communication, or public-facing material.
3. Prohibition on Re-Identification
   
   1. You must not, and must ensure your Authorized Users do not:
      
      1. attempt to re-identify any participant or individual from the Covered AI Product Data or Outputs;
      2. combine or correlate Covered AI Product Data with any other dataset, model, tool, or information source for the purpose of re-identification; or
      3. use Covered AI Products in any way that could reasonably lead to the identification of a participant or breach of Data Protection Law.
   2. Any attempt to re-identify a person constitutes a material breach of these Terms
4. External Use and Attribution
   
   1. You may use Permitted Insights for external or commercial purposes (External Use), provided that:
      
      1. the information shared constitutes Permitted Insights;
      2. no Restricted Information or Personal Data is included;
      3. External Use does not misrepresent the nature, scope, or reliability of the Covered AI Products or Outputs; and
      4. any attribution to Askable is accurate and does not imply Askable endorsement unless otherwise agreed in writing
   2. Askable is not responsible for the accuracy, interpretation, or consequences of any External Use of Permitted Insights by you
5. Anonymisation and Data Protection
   
   1. Askable uses technical, procedural, and administrative measures designed to remove or minimise Personal Data within Covered AI Product Data before it is made available as part of the Askable Industry Streams. However, Covered AI Product Data may still contain limited Personal Data or be subject to the inherent risk of re-identification when combined with other information.
   2. You must ensure that all Internal Use and External Use of Covered AI Product Data, Outputs, and Permitted Insights complies with these Terms, applicable laws, and all obligations regarding Personal Data in the Askable Software Services Agreement.

1.3 Your Obligations

You must, and must ensure each of your Authorized Users:

1. comply with all reasonable directions given by us in connection with the Covered AI Products, including any recommendations regarding backup routines, security settings and virus checking;
2. ensure all usernames, passwords and other account information associated with the Covered AI Products, are kept up-to-date, secure from unauthorised use or access, and promptly notify us of any known or suspected unauthorised use of or access to your account;
3. report to us immediately and use reasonable efforts to immediately stop any activity in breach of these Terms;
4. must not use any Covered AI Products in a way that would contravene any artificial laws or result in a high risk use. 
5. comply with these Terms and Askable Software Services Agreement. 

1.4 Prohibited Conduct

You must not, and must ensure your Authorized Users do not access and use the Askable Industry Streams (including any Covered AI Products Data):

1. in a way that we consider is inappropriate or unlawful, infringing on any third party’s rights (including Intellectual Property Rights), misleading, deceptive, discriminatory, harmful, otherwise inappropriate, or in breach of the Agreement;
2. in a way that causes, or is likely to cause, us to breach Data Protection Laws  in relation to the Covered AI Products and Covered AI Products Data; and
3. in a way that is inconsistent with our Terms. 

1.5 Authorized Users

You may permit Authorized Users to exercise the rights granted to you under these Terms on your behalf provided that:

1. you are responsible for ensuring such Authorized Users comply with these Terms;
2. you agree you are responsible for any breach of these Terms by such Authorized Users, 
3. and you indemnify us in relation to any claims, damages or losses arising in connection with any breach of these Terms by such Authorized Users.

1.6 Updates and New Versions 

1. During the Term, we may:
   
   1. make fixes, modifications, enhancements or updates available to you in relation to Askable Industry Streams at no further cost (Updates); and/or
   2. make available to you new versions of the Askable Industry Streams with materially significant differences from the previous versions, subject to you agreeing to pay any applicable additional fees (New Versions). 
2. All Updates and New Versions are part of the original licensed copies of the Askable Industry Streams and will be governed by these Terms.

2. Askable AI 

1. Askable may use one or more third-party artificial intelligence (AI) service providers (collectively, AI Providers) to deliver, enhance, or support functionality across the Covered AI Products.  These AI Providers act as subprocessors engaged by Askable to process data on its behalf.  The current list of subprocessors, including AI Providers, is maintained at trust.askable.com/subprocessors.  
2. AI Providers may support a range of capabilities, including but not limited to transcription, language processing, data analysis, summarisation, and content generation.  These services operate across multiple Askable features and are not limited to any particular product, workflow, or Industry Stream.  Askable may substitute or rotate between AI Providers at its discretion to maintain reliability, compliance, and service continuity.
3. When accessing or using features powered by AI Providers, you agree to:
   
   1. use AI-generated content responsibly and in compliance with all applicable laws and regulations;
   2. review and verify any Output before relying on or sharing it;
   3. avoid using or distributing Outputs in a manner that may cause harm, mislead others, or misrepresent their origin; and
   4. avoid submitting Personal Data or Confidential Information as Input unless you have all relevant rights and authorisations to do so.
4. Askable endeavours to ensure that each AI Provider processes data only under Askable’s documented instructions and solely for the purpose of providing the contracted services.
5. Askable’s service-level commitments do not apply to any performance issue, delay, or failure arising from the acts, omissions, or unavailability of any third-party AI Provider or other external service upon which the Askable Platform relies. In the event that any Askable Industry Stream becomes unavailable or is interrupted, Askable will take reasonable steps to mitigate and restore affected functionality as soon as practicable.

3. Input and Output

1. To use Askable AI, you must provide text or data input (Input) to receive related output (Output).
2. You acknowledge and agree that:
   
   1. Output may not be accurate, complete, free of errors, or unique; and
   2. we do not make any warranty as to Covered AI Products,, the Output, or the results that may be obtained from the use of Covered AI Products, or the accuracy of any information obtained through Covered AI Products,, including with respect to the factual accuracy of any Output or suitability for your use. Use of any Output is at your sole risk. You should not rely on factual assertions in Output without independently fact checking their accuracy and assessing the suitability for your use. You are solely responsible for the accuracy, legality, and suitability of any use you make of Outputs.
3. Personal Data (including any sensitive personal data in the Covered AI Data) may be included in Inputs to the Covered AI Products, and may be generated as Output. Such data may be processed by third party AI Providers acting as subprocessors.

4. Data

1. You acknowledge and agree that:
   
   1. Output may not be accurate, complete, free of errors, or unique; and
   2. we do not make any warranty as to Covered AI Products,, the Output, or the results that may be obtained from the use of Covered AI Products, or the accuracy of any information obtained through Covered AI Products,, including with respect to the factual accuracy of any Output or suitability for your use. Use of any Output is at your sole risk. You should not rely on factual assertions in Output without independently fact checking their accuracy and assessing the suitability for your use. You are solely responsible for the accuracy, legality, and suitability of any use you make of Outputs.
2. With respect to any Personal Data included as Input by you, you acknowledge that Askable acts as the controller and processor of your Personal Data to operate, maintain, and support the Askable Industry Streams (e.g. generate responses, ensure security, troubleshoot) in accordance with the Agreement, these Terms, the Documentation, your instructions, and for the purposes set out in our Privacy Policy and the Data Processing Addendum.
3. You may request deletion of any data related to your use of the Covered AI Products, (including chat history, Outputs, ingested transcripts, generated concepts/evidence, and linkages) at any time by written request to us (including on termination).
4. We reserve the right to delete any such data at our discretion (for example, to maintain system performance or improve service reliability).
5. We may use deidentified data for any purpose, including to train AI models.

5. Definitions 

1. Authorized User means a person you have permitted to use the Askable Products.
2. Covered AI Products Data means industry research and business insight data (including Personal Data) that is compiled and made available to you by Askable as part of the Services;
3. Personal Data has the meaning given to it in the Askable Data Processing Agreement.
4. Data Protection Law has the meaning given to it in the Askable Data Processing Agreement.
